The federal agency investigating a deadly construction accident last year in Branson has cited a Lake of the Ozarks sub-contractor and fined the company 12-thousand-600 dollars.

OSHA, the Occupational Safety and Health Administration, has handed out three citations against Midwest Coatings of Kaiser in the death of 41 year old Ray Strawn of Brighton, who was killed November 6th, while working at the Palace View Resort in the 7-hundred block of Blue Meadows Road.

Initial reports the day of the accident say Strawn died after falling some 25 feet off a small fork lift. OSHA claims the driver of the forklift wasn’t properly trained, a scaffold platform on the forklift wasn’t properly attached, and the scaffold platform didn’t have proper protection on all four sides.

OSHA Spokeswoman Barb Theriot tells HometownDailyNews.com the company has decided to appeal the decision after meeting with OSHA investigators:

Theriot said there is no time frame established for complete resolution, and cases of this nature have been known to go on for months, if not years.

A spokesperson for Midwest Coatings declined comment when contacted by HometownDailyNews.com

The general contractor at the construction site at the time of the accident, Larry Snyder Construction of Ozark was not cited following the investigation.

OSHA spokeswoman Barb Theriot says the company met with agency investigators, but a resolution couldn’t be reached, so the case moves forward to litigation:

So sad for the family to have to go through this...My thoughts and prayers are with them.

This is such a sad story. This was such a preventable death. The contractor filing an appeal is absurd. How many things were identified that should not have taken place or been allowed? This is a case of a responsible party ALLOWING improper techniques and practices to go on. I wonder if the owner of Midwest Coatings would have allowed his loved ones to work with the same conditions that his company allowed that day? May the family of Mr. Strawn find peace in all this.
