BREAKING: Racetrack Scheduled to Open in March 2014, Higher Noise Levels Approved

Developers of the Branson Sports Entertainment Complex now say a proposed racetrack South of Hollister near Highways 65 and 86 is scheduled to open in March of 2014, and when it does, it will be allowed higher levels of noise than originally approved.

By a vote of 3 to 1, The Taney County Board of Adjustment changed its mind last night, and approved raising the sound level from a base of 68 decibels that was originally approved by Planning and Zoning, up to a spiked level of 73 decibels.  That number is still shy some 10 decibels the racetrack asked for in its second appeal.

Racetrack spokesman Nathan Adams was asked by HometownDailyNews.com if developers were happy with the outcome of the re-hearing – despite not getting everything they asked for.

Another Planning and Zoning decision dealing with the racetrack development was also overturned last night on its second appeal. The Board of Adjustment said developers could phase in infrastructure as the project moved forward, rather than having all the road and sewer work done prior to building any offices or other facilities on site.

It’s likely the case will end up in court before any green flag is dropped at the track.  Several angry neighbors voiced their displeasure as they left the packed hearing room at the Taney County Courthouse, with some saying out loud, they would be filing lawsuits.

The four hour meeting itself was very emotional, with the board chairman pounding a gavel several times, asking for quiet from the boisterous crowd, relying on the sheriff to help restore order.

In a re-hearing, the Board approved letting developers build the infrastructure around the complex in stages, rather than complete ALL roads and sewers before any offices or other facilities are built on site. 

While several neighbors voiced their displeasure during the 4-hour meeting, that at times had to be silenced and called to order by the chairman, a racetrack spokesman said he was pleased with the outcome.  Nathan Adams talked with HometownDailyNews.com in the hallway outside the hearing room:

The Board of Adjustment also overturned another original ruling somewhat, by agreeing to raise noise level restrictions at the track from a base level of 68 to a spiked level of 73 decibels.  But that’s still some 10 decibels shy of what the racetrack developer asked for.

That decision could be appealed in court, and some neighbors opposed to the overall project have threatened legal action as well.

Now tell us who are all the partners in this cluster?If a race track saves this town I will be very very suprised.I am continually suprised how you people can screw up a home ive known for 50 years .

Isn't it just something else that a "Board" that is suppose to represent the County goes against its citizenry and a Sheriff has to restore order. That's the real way to make friends and influence people in Taney County. This is going to be better than any Branson show. As for these peoples past accomplishments, one only has to look at the hole in the ground across the street north from WalMart. I believe this is their "doings"

Thank you to the board! You have effectively ruined the value of my lifestyle, the value of my home and you have thumbed your noses at the CODE BOOK. Karma has a way of getting back around. Good job! Congratulations are in order to the 'BS' entertainment complex! Oh, wait a minute! There is a $5 million judgement on said property and a cease and desist and another lawsuit pending. Can any work go on with liens levied against this property? Did anyone notice a board member with connections to Cape Girardeau? The same place Gammon is from? ODD? or coincidental? HMM?

So, the commission broke no laws at the first hearing? The BOA upheld those decisions then, but with a change of heart(?)they now have decided the commission was...inept, not schooled in the process or on what to decide, or did they finally get the lining of their pockets upgraded? Guess we'll never know for sure. But shame on the board for passing this but not the woman on Poverty Point that wants to have a nightly rental less than 1/2 Mile from a motel. How does that figure? Neighbors of this hime said it would erode the neighborhood at Poverty Pt. Too bad a racetrack wasn't offered up, apparently there would be no erosion. I use erosion figuratively but the Corp of Engineers used it literally with BS entertainment complex.

Um, good luck with a lawsuit-attorneys AREN'T cheap-court process takes forever, the track will be done before you go to court, and in the end you will have spent a ton of money and probably lose anyway. If you don't like it-I suggest you think about moving. People complained about the airport too. Good luck.

I bet none of the board of adjustments members live near this proposed racetrack, Its one thing to move next to a airport or a track then complain about the noise. But to have both a airport and now a racetrack move in the area. some of us long time residents want the area to remain quite, if you was more income move away and make your money. I could care less if one more person moved into taney county.

How can anything happen at this site? Missouri Courts show a $5+million judgement against the property.

My daughter goes to college in Boone, IA and Boone Speedway is right there about a mile from her college apartment. At the beginning of the school year she and a lot of the kids couldn't sleep because of the noise. Did any of the Board members contact other cities where there are racetracks to see what issues they have? I would contact Boone as they are just as a small town as we are to see what pros/cons they came across by having this racetrack in their town.

all these folks that live by the track are complaining it will drop their prop vaule down. i dont think so if anything it will raise it up having and airport, race track etc. also i never saw or heard them complaining about the airport going in and that is louder going right over their house. it will bring more job to the people here who are trying to feed their family,also more money to the town and state. i think its great i am so looking forward to it and so many of my friends and family are also, i know many hoping they will be able to get a job and off unemployment. i feel the town really needs this also in line of jobs for many. they are just thinking of them self and not others what it will mean and do. thank you Kathryn

I don't even live here and see how developers greed has ruined the beautiful ozark landscape with failures. It's all about money these days. Like gambling, that venue doesn't belong in this area. Jobs are a great addition, but the facts are that this racetrack is way to large for the population of the area, and financially won't make it for very long. It is only usable 6 months a year. The rest of the time, it will sit idle with people laid off work, and the local landscape ruined forever. At least the airport serves a purpose year around,and does provide year around employment. The people who bought and built homes in that area for the ozark beauty, peace and quiet are understandibly upset. I guess big money talks when it comes to politicians, no matter what the people want.
