State Supreme Court To Decide Where Stone County Lawsuit Will Be Heard

It’s now up to the Missouri Supreme Court to decide where a lawsuit Stone County Clerk Judy Berkstresser filed against the county she works for will be heard.

Berkstresser is suing Stone County for personal injury damages related to a car crash a year ago this month on Billy Joe Road.

The suit was filed last week and it names Stone County and Commissioner Dennis Wood as the defendant.

To avoid an appearance of impropriety, Stone County Circuit Court Judge Robert Wiley has refused to hear the case, asking the State Supreme Court to assign a new judge. Online court records indicate the judicial transfer request was mailed to the office of State Courts Administrator on Wednesday.

Berkstresser claims the county was negligent related to road safety at the crash site, saying there was a lack of stop signs at the intersection of Marble Road

She suffered multiple injuries, including a broken leg, pelvis and hip after being hit by another vehicle January 6th, 2011.

Berkstresser is asking for damages to cover her medical expenses, and for Stone County to pay punitive damages for other relief the court deems just and proper.

Berkstresser’s husband Allen, is also suing the county, claiming, among other things, that he has been deprived of her companionship.

Stone County Clerk Judy Berkstresser is suing the county she works for, claiming Stone County was negligent related to road safety after she was involved in a car accident a year ago this month.

Berkstresser is asking for damages to cover her medical expenses, and for punitive damages for other relief the court deems just and proper.  She was involved in a wreck at the intersection of Billy Joe Roadand Marble Roadon January 6th, 2011.

Berkstresser claims there weren’t enough stop signs at the intersection.

Stone County Circuit Court Judge Robert Wiley has recused himself, and is asking the State Supreme Court to appoint another judge to hear the case.

This lady can't be in her right mind, What just because the A-hole that hits you doesn't have insurance, and you don't carry enough insurance, that you can go ahead and sue the county that you not only live in but also are employed with. LOL this lady is a genius and her husband also suing the county for lack of "companionship".....Just because her pelvis was broken didn't mean she wasn't there. What is this world coming too?

when I first read this I thought surely this is a joke, but alas it is not April 1st! I totaled my car last winter in the storm, which resulted from a fractured hip, which ultimately was replaced. I had chiropractor adjustments for several months on a broken hip. I never would dream of suing. Seriously and you WORK for the county!

The report said SHE was making a left turn and turned into the path of a 1999 Ford Ranger. Also the report stated two possible factors were a hill that obstructed the view and possible STOP signs stolen. Correct me if Im wrong LEFT turn means Yeild to oncoming traffic! I guess she expects the hill to disappear and stop signs to be everywhere to replace common sence driving.

Why sue the taxpayers? Insurance is provided for her, and as far as her husband Allen Berkstresser suing the County for deprived companionship!!! I think the County has paid enough already for women that sued Stone County while working under the Assessor Berkstresser. Wake up Stone County.

As as stone county tax payer, I know that she has medical insurance to cover her medical bills because I pay my taxes that pay for her insurance. Money Hungry is all it comes down to. She also states to be a minister of a church! That really gives churches a good name! She fails to yield at her stop sign. I guess if there would have been a stop sign for the other driver, she would have gotten away with running hers!
